RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK

1. Who is released. “Released Parties” means Taghavi Farms; every business entity, trade name, and assumed name through which it operates; its owners, officers, managers, members, employees, volunteers, and agents; the vendors, concessionaires, contractors, animal handlers, and food providers at the Taghavi Farms pumpkin patch in City of Commerce shown above as today’s location (the “Location”), and their employees; the owner, landlord, property manager, and lessor of the Location, and of the property it sits on; and the insurers of all of them.

2. Where I am, and the risks I accept. The Location is a temporary seasonal attraction built from portable equipment and structures, set up on paved parking areas and other surfaces. I may take part in walking on pavement covered with straw; picking and carrying pumpkins; slides, inflatables, games, and play structures put up on a hard surface; hay bales and hay structures; carts and wagons; a petting zoo and other contact with live animals; food and drink sold on site; and any other attraction, activity, or service offered here, whether or not listed above and whether or not supervised.

Subject to Section 5, I accept the risk of injury, illness, and death from all of it, including slips, trips, and falls caused by pavement, straw, curbs, wheel stops, cords, anchors, uneven surfaces, and other conditions, seen or unseen; being struck by, run over by, or crushed against a vehicle, including customer, employee, vendor, and delivery vehicles moving in or around the site; and falls, collisions, and the collapse, deflation, or movement of any temporary structure, including in wind.

I also accept the risk of bites, kicks, and trampling by animals, which can happen without warning even with tame animals; illness carried by animals, including E. coli, Salmonella, and Cryptosporidium, which can cause severe or fatal illness, especially in young children; foodborne illness and allergic reactions; and communicable disease spread by other people.

I also accept the risk of weather and wind; the acts of other guests, including guests who are under the influence of alcohol or drugs, whether obtained on site or not, and who may be unsteady, careless, or aggressive, may fail to control their own children, and may operate vehicles in and around the site; and equipment, structures, or ground that fail or are not adequately built, anchored, maintained, inspected, supervised, staffed, lit, fenced, or marked.

I will not use any attraction, and will not supervise a child, while under the influence of alcohol or of any drug that impairs coordination or judgment.

3. Release, including of the Released Parties’ own negligence.

4. Children. For each minor child accompanying me or in my care at the Location, I am the child’s parent, legal guardian, or an adult authorized by a parent or guardian to act for the child, and I have authority to execute this agreement on the child’s behalf. Each such child is covered by this release whether or not the child is identified by name. If no minor child is accompanying me or in my care, the rest of this Section 4 does not apply to me. I give this release for myself and, to the fullest extent California law allows, on behalf of each such minor child, and I agree not to bring, or help anyone bring, a claim covered by this release, for myself or for any such child. I also give up my own claims arising out of any such child’s injury, illness, or death, including medical expenses, loss of services, emotional distress, and wrongful death. If a claim covered by this release is brought by or for any such child, I agree, to the fullest extent permitted by law, to indemnify and defend the Released Parties against it, except as to conduct excluded by Section 5. Every minor child in my care stays under my supervision at all times, including in the animal area and anywhere vehicles move. I decide which attractions are right for each child, and I will keep each child within any age, height, and size limits that the Released Parties announce or post. The Released Parties do not supervise children.

5. Limits. Sections 2, 3, and 4 are subject to this Section 5. This release, and the assumption of risk in Section 2, cover ordinary negligence to the fullest extent California law allows. They do not cover gross negligence, and they do not release any claim that cannot lawfully be released. If any part is unenforceable, that part is narrowed or removed and the rest still applies.

6. Photographs and video. I consent, for myself and any minor child accompanying me or in my care, to being photographed and filmed here, and to the Released Parties and those they authorize using the images for any lawful purpose, including advertising, without payment. This consent is separate from the release. If I do not consent, I can tell a staff member when I enter, and declining will not affect my admission or the rest of this document.

7. Other terms. California law governs. This release covers every visit that I, or any minor child in my care or accompanying me, make during the 2026 season to the Location. Being allowed to enter the Location is the exchange for this release, each time I enter it. A copy, scan, or electronic signature counts as an original. I authorize emergency medical care for me and for each minor child in my care or accompanying me, at my expense.
